4. COUNCIL ON MONASTERIES

Art. 47. The Judicial Council consists of eight persons who are learned in law, married, and having completed forty years of age, four of whom shall be ecclesiastics and four laymen. The president of the Judicial Council is the Vicar of the Patriarch; and all its members are elected by the Mixed Assembly by a plurality of votes. The function of the Judicial Council is to resolve family disputes, and to examine and decide, in accordance with the referral, those cases transmitted to the Patriarchate by the Sublime Porte. When a case occurs which the Judicial Council deems [to be] beyond its competence, it shall indicate the necessity of referring it, according to the nature of the matter, either to the Religious [Assembly], or to the Civil [Assembly], or to the Mixed Assembly. If the convicted party appeals against a judgment decided in the Judicial Council, the matter shall be re-examined in one of the aforementioned Assemblies to which it pertains.
